1. Acceptance of These Terms

These Terms & Conditions ("Terms") govern your access to and use of the Travel Bunny virtual travel assistant web application (the "Service"), provided by Travel Bunny Pty Ltd (ABN 20700190521, "Travel Bunny", "we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.

If you do not agree, do not use the Service. These Terms should be read together with our Privacy Policy, which explains how we collect and handle personal information.

2. Description of the Service

Travel Bunny is a conversational AI assistant that helps users research destinations, plan itineraries, and explore travel options. The Service is powered by Claude, a third-party AI model provided by Anthropic, PBC, operating within guardrails, response limits, and configurations that we control.

The Service is a research and planning aid only. It does not book flights, accommodation, or activities, and it is not a licensed travel agency, financial advisor, or immigration adviser. Any bookings, purchases, or arrangements you make based on information from the Service are made directly with the relevant third-party provider and are subject to that provider's own terms.

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Attempt to bypass, probe, or interfere with guardrails, rate limits, or security features of the Service;
• Use the Service to generate content that is illegal, fraudulent, defamatory, or infringes the rights of others;
• Submit malicious code, attempt to reverse-engineer the Service, or extract underlying model prompts, weights, or system configurations;
• Use automated means (bots, scrapers) to access the Service without our written permission;
• Resell, sublicense, or commercially exploit the Service without our written permission;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

We may investigate and take appropriate action against anyone who violates this section, including suspending or terminating accounts, as described in Section 9.

The Service may reference, link to, or integrate with third-party websites, travel providers, booking platforms, or payment processors. We do not control and are not responsible for the content, accuracy, or practices of any third party. Your use of third-party services is governed by their own terms and privacy policies.

8. Fees and Payment

The Service is currently provided free of charge. We may introduce paid plans, subscriptions, or in-app purchases in the future. If we do, updated terms covering pricing, billing, refunds, and cancellation will be presented to you before any charge applies, and your continued use of paid features will constitute acceptance of those terms.

9. Suspension and Termination

We may suspend or terminate your access to the Service, in whole or in part, at our discretion, including where we reasonably believe you have violated these Terms, engaged in misuse or abuse of the Service, or where we are required to do so by law, with or without notice.

You may stop using the Service and close your account at any time by contacting us at joshua.l.mertens@gmail.com. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law) will continue to apply after your access ends.

10. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and noninfringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted, or modified. Where our liability cannot be excluded but can be limited, our liability is limited (at our option) to resupplying the Service or paying the cost of having the Service resupplied.

11. Limitation of Liability

To the maximum extent permitted by law, and subject to Section 10 above, Travel Bunny and its officers, employees, and service providers (including Anthropic) will not be liable for any indirect, incidental, special, consequential, or exemplary damages, including loss of profits, data, or travel costs, arising from your use of or reliance on the Service.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) the total fees you paid us in the 12 months before the event giving rise to the claim, or (b) AUD $100.

12. Indemnity

To the extent permitted by law, you agree to indemnify and hold Travel Bunny harmless from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

13. Changes to the Service and These Terms

We may modify or discontinue features of the Service, and may update these Terms from time to time, at our discretion. We will post the updated Terms with a new "Last updated" date, and where changes are material, we will provide additional notice (such as an in-app notification or email). Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Victoria, Australia. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Victoria, Australia, without prejudice to any non-excludable right you may have to bring proceedings in your own jurisdiction under applicable consumer protection law.

Before commencing formal proceedings, both parties agree to first attempt to resolve any dispute informally by contacting joshua.l.mertens@gmail.com.

15. General

• Entire agreement: these Terms, together with our Privacy Policy, constitute the entire agreement between you and Travel Bunny regarding the Service.
• Severability: if any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.
• No waiver: our failure to enforce any provision is not a waiver of our right to do so later.
• Assignment: we may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign these Terms without our consent.
